(AP) ? James Holmes appeared just as dazed as he did in his first court hearing after the deadly Colorado movie theater massacre.

Holmes, 24, sat silently in a packed Denver-area courtroom on Monday, as a judge told him about the charges filed against him, including murder and attempted murder, in one of the deadliest mass shootings in recent U.S. history.

After the charges were read, prosecutors and defense attorneys sparred over whether a notebook that news reports said Holmes sent to his psychiatrist and had descriptions of the attack was privileged information.

It's an argument that foreshadows one of the case's most fundamental issues: Does Holmes have a mental illness and, if so, what role did it play in the shooting that left 12 people dead and 58 others injured?

Sam Kamin, a law professor at the University of Denver, said there is "pronounced" evidence that the attack was premeditated, which would seem to make an insanity defense difficult. "But," he added, "the things that we don't know are what this case is going to hinge on, and that's his mental state."

In all, prosecutors charged Holmes with 142 counts in the shooting rampage at a midnight showing of the new Batman movie.

Holmes faces two first-degree murder charges for each of the 12 people killed and two attempted first-degree murder charges for every one of the 58 injured in the July 20 shooting.

The maximum penalty for a first-degree murder conviction is death. The multiple charges expand the opportunities for prosecutors to obtain convictions.

"It's a much easier way for the prosecution to obtain a conviction," said Denver defense attorney Peter Hedeen. "They throw as many (charges) up as they can. If you think you can prove it three different ways, you charge it three different ways."

Unlike Holmes' first court appearance July 23, Monday's hearing was not televised. At the request of the defense, District Chief Judge William Sylvester barred video and still cameras from the courtroom, saying expanded coverage could interfere with Holmes' right to a fair trial.

A shackled Holmes did not react as the charges were read. At one point, Holmes, his hair still dyed orange-red, leaned over to speak with one of his lawyers and furrowed his brow. When the judge asked him if he was OK with postponing a hearing so his team could have time to prepare, he said softly: "Yeah."

Some court spectators Monday wore Batman T-shirts. Several people clasped their hands and bowed their heads as if in prayer before the hearing. At least one victim attended, and she was in a wheelchair and had bandages on her leg and arm.

For the murder charges, one count included murder with deliberation, the other murder with extreme indifference. Both counts carry a maximum death penalty upon conviction; the minimum is life without parole.

In addition, Holmes was charged with one count of possession of explosives and one count of a crime of violence. Authorities said Holmes booby trapped his apartment with the intent to kill any officers responding there the night of the attack.

A conviction under the crime of violence charge means that any sentence, including life terms, would have to be served consecutively, not concurrently, said Craig Silverman, a former chief deputy district attorney in Denver.

That ensures that if laws change in the future, the person convicted would still serve a lengthy sentence, Silverman said.

Analysts expect the case to be dominated by arguments over the defendant's sanity.

Under Colorado law, defendants are not legally liable for their acts if their minds are so "diseased" that they cannot distinguish between right and wrong. However, the law warns that "care should be taken not to confuse such mental disease or defect with moral obliquity, mental depravity, or passion growing out of anger, revenge, hatred, or other motives, and kindred evil conditions."

Holmes' public defenders could argue he is not mentally competent to stand trial, which is the argument offered by lawyers for Jared Loughner, who is accused of killing six people in 2011 in Tucson, Ariz., and wounding several others, including U.S. Rep. Gabrielle Giffords.

If Holmes goes to trial and is convicted, his attorneys can try to stave off a possible death penalty by arguing he is mentally ill.

Prosecutors will decide whether to seek the death penalty in the coming weeks.

Prosecutor Tamara Brady said Monday she will subpoena University of Colorado, Denver, psychiatrist Lynne Fenton, whom Holmes had been seeing, to testify in a dispute over whether the notebook is privileged because of a possible doctor-patient relationship.

Arapahoe County District Attorney Carol Chambers disputed news reports that the notebook contained descriptions of an attack.

On Friday, court papers revealed that Holmes was seeing Fenton. They did not say how long or if it was for a mental illness or another problem. An online resume listed schizophrenia as one of Fenon's research interests.

Holmes' public defenders want to know who leaked the information to the news media. Prosecutors say the notebook was inside a package Holmes reportedly sent to Fenton at the university. Holmes came to the school's competitive neuroscience doctoral program in June 2011 and dropped out a year later.

Authorities seized the package July 23, three days after the shooting, in the mailroom of the medical campus where Holmes studied. A hearing on the matter was set for Aug. 16.

Sylvester set an Aug. 9 hearing on news organizations' motion seeking to unseal the case docket.

Sylvester has tried to tightly control the flow of information about Holmes, placing a gag order on lawyers and law enforcement, sealing the court file and barring the university from releasing public records relating to Holmes' year there.

HBT: White Sox acquire LHP Liriano from Twins

As first noted by Mike Axisa of MLB Trade Rumors, the White Sox acquired lefty starter Francisco Liriano from the Twins on Saturday night for infielder Eduardo Escobar and left-hander Pedro Hernandez.

Liriano drew trade interest from the Angels, Orioles, Cardinals, Blue Jays, Mets and Braves in recent weeks, but it was the Pale Hose and GM Kenny Williams who were able to figure out a deal.

Liriano, a 28-year-old?impending?free agent, has registered a poor 5.31 ERA and 1.44 WHIP in 22 appearances (17 starts) this season, but he?s fanned over a batter per inning and put together dominant stretches at times. The first-place White Sox will hope that he can get hot and stay hot through October.

Escobar, 23, was hitting just .207/.281/.276 in 36 games this season for Chicago and doesn?t carry much upside. Hernandez owns a 3.42 career ERA and 1.24 career WHIP in five-plus minor league seasons, but he doesn?t have great swing-and-miss stuff (7.6 career K/9) and projects as a mediocre MLB starter.

It sure seems like a low-risk deal for the White Sox. And one has to wonder whether the Twins could have done a little better in a return package had they waited for the July 31 trade deadline to draw a little closer.

Apps for speech therapy: Category Apps

Category Carousel: This app was developed by speech pathologist Lois Kam Heymann. The app offers nine general categories: transportation, animals, clothing, food, occupations, household, summer, winter and instruments. There are subcategories within animals (birds, bugs, farm, water, jungle, forest), transportation (land, water, sky), clothing (body, head, feet), food (breakfast, desserts, drinks, meat, fruit, vegetables), and household (cleaning, furniture, toys, tools, bathroom, kitchen). The screen for each category presents 12 photographs of items within the category selected. The child needs to drag each of the pictures into the category icon at the top of the screen. Each picture touched is named and when it is dragged into the icon two things happen: the number of items placed into the icon are counted and shown with a number and there is verbal praise. I like the large variety of items presented for some categories. For the categories with many pictures, each time a picture is placed in the icon, new picture appears on the screen so that there are always 12 pictures from which to select until the picture limit is reached. Some categories, such as winter, have only 12 pictures. One has the option of rotating the pictures on the screen by tapping the circular arrows at the bottom.

Although the focus of this app is categories there really is no challenge for the child in this respect. This is because the child does not need to determine the category nor sort pictures according to their categories. The challenge only occurs when the child needs to sort pictures into their subcategories. This app, however, is a good choice for vocabulary learning.

LONDON (AP) ? Dana Vollmer won a gold medal at the Olympics and set a world record, too.

Not bad for someone who didn't even qualify four years ago.

On a night featuring a relay duel between the Australians and the Americans, Vollmer got things started with a bang Sunday in the 100-meter butterfly. She was third at the turn but powered to the wall for a time of 55.98 seconds, beating the record of 56.06 set by Sweden's Sarah Sjostrom in a since-banned high-tech bodysuit at the 2009 world championships.

The American dropped back her head when saw the time, then broke into a huge smile, slapped the water and pumped her fists.

"I'm on top of the world right now." she said. "I still know I can go faster."

Vollmer, who made the Olympics as a 16-year-old in 2004, was a huge disappointment when she failed to make the team in Beijing in 2008. She was slowed by injuries and health problems, making her question whether she even wanted to continue swimming.

But her injuries healed and a change in diet gave her a new outlook. She came close to breaking Sjostrom's record at the U.S. Olympic trials last month, and set an Olympic record in the semifinals to come in as the top qualifier.

Now she's an Olympic champion.

"I kept telling myself that my strength is my second 50," Vollmer said. "I kept really calm."

Lu Ying gave China another medal at the Olympic Aquatics Centre, taking silver in 56.87. Australia's Alicia Coutts grabbed the bronze in 56.94.

"It's not bad," Lu said. "It's the result, more or less, I hoped for."

It was a tough night for Sjostrom. Not only did she lose her world record, she didn't even get a medal, touching fourth in 57.17.

Vollmer was the second swimmer to set a world record at the London Games, and only the fourth to break a mark set during the rubberized suit era. Those suits were banned after an astonishing 43 world records were set at the 2009 world championships.

The big race on the second night of swimming was the men's 400 freestyle relay, which figured to be a duel between defending world champion Australia and the United States, which won the Olympic title four years ago.

The Americans sent out their big guns, going with Michael Phelps and Ryan Lochte in hopes of knocking off a favored Aussies team that included James "The Missile" Magnussen and James "The Rocket" Roberts. Nathan Adrian and Cullen Jones also were swimming for the U.S., which changed up its entire lineup after qualifying second in the morning preliminaries.

The Aussies posted the fastest qualifying time with a quartet that included Magnussen and Roberts. They changed up the other two spots, going with Matt Targett and Eamon Sullivan.

There were two other finals Sunday night.

In the men's 100 breaststroke, Japan's Kosuke Kitajima was attempting to become the first male swimmer to win the same individual event at three straight Olympics. Phelps failed miserably at his attempt the night before, failing to even medal in the 400 individual medley. Also, Britain's Rebecca Adlington looked to give the home country its first swimming medal and defend her title in the 400 freestyle.

Brewer student's film wins Maine Student Film and Video Festival ...

BANGOR, Maine ? Despite dabbling in filmmaking since the age of 6 and producing and-or directing several short films over the last 10 years, Jacob Caron had never entered a film in a competition.

Knowing about his love and interest for filmmaking, Tam Caron ? one of his aunts ? suggested he produce one and enter it in the 35th annual Maine Student Film and Video Festival.

The only problem was the Brewer High School student had just two weeks to create, edit and submit a film by the festival deadline.

?The good news was the festival rules weren?t too limiting. The bad news was I had two weeks to do it and it was the last two weeks of school,? said Caron, who lives in Eddington. ?But I thought about it and figured I might as well go for it. No guts, no glory.?

Just over a month later, the 17-year-old senior-to-be is basking in the glory after his short film titled ?Freedom of the Press? beat out 29 other entries and won the festival?s grand prize.

?I think there were 29 other film entries. It was kind of overwhelming. When I found out I won, I couldn?t believe it,? Caron said. ?I expected someone else with a more dramatic or thematic film to win.?

Caron?s 13-minute film is part ?Goodfellas,? part ?Untouchables,? part ?Stand By Me? and part ?Doogie Howser, M.D.? without the M.D. It chronicles the activities of the New England Mafia, run by the youngest organized crime boss in the country, and a young, crusading journalist who has been hired by a local newspaper editor to do an expose on the criminal organization.

?This is by far the longest film I?ve done. The previous longest one was seven or eight minutes,? said the son of Drew and Nancy Caron. ?My friends and I put this together in two weeks.?

And they did it under budget. Way under budget.

?My friends acted with payment of a large pizza after the shoot,? Caron said with a laugh. ?I think my total expense was about $30 for clothes at Goodwill.?

Caron not only directed the film, he also acted (playing two parts as a TV reporter and the newspaper editor), filmed, cast and handled most of the production work. He even composed his own musical score.

?All the music for this had to be original. I play piano, so that helped me be able to mix a score for the movie,? he said.

Caron, who also is entering his film in the Portland Film Festival student division, did all the musical scoring on deadline day for the film?s submission.

The film was shot at various locations all over Bangor, Brewer and Orono, including his mother?s optometrist office. It was a marathon effort packed into a tight time frame.

?I could barely keep my eyes open in school some days. We were all exhausted,? said Caron. ?We had several all-nighters, including the last day before the deadline.?

Caron unintentionally bucked a couple of trends with his movie. He went longer than the suggested 10-minute limit and he elected not to go with a drama filled with imagery, enigma or esoteric, outside-the-box themes.

?I wasn?t really too into that, so I figured I?d make something different, and something they hadn?t seen before,? he said.

At the screening of his film last Saturday, it was apparent many in attendance hadn?t seen this before.

?At the screening, there was a big population of children under the age of 10 because they grouped all the kids? films together with the older one,? Caron explained. ?Once the F-bombs started and the lead pipe [used in an implied mob beating scene] came out, the theater doors started opening and kids started leaving.

?There were a few dirty looks from parents and about half the theater cleared.?

Still, Caron, whose older sister Rachel is majoring in performing arts in college, got high marks from the three judges at the competition and won a two-week scholarship to the Maine Media Workshop to learn from filmmakers, editors and videographers from all over the world earlier this month.

?One of the festival officials said he couldn?t believe this kind of film came from a student,? Caron said. ?They liked the cinematography, camera angles and the lighting.?

Not bad for a guy whose school doesn?t even have a film club. That made the workshop an even greater opportunity for someone hoping to major in film study at either the University of Southern California or University of California Los Angeles.

?The whole thing was a really cool experience,? he said. ?Even with all the sleep deprivation.?
