>>> developing news within the past hour, the white house reacting to a secret 16-page justice department memo exclusively obtained by nbc news. in it, obama administration lawyers argue the government can kill americans believed to be top taliban leaders posing, quote, an imminent threat of attack against the united states .

>> we have acknowledged the united states that sometimes we use remotely piloted aircraft to conduct targeted strikes against specific al qaeda terrorists to prevent attacks on the united states and to save american lives. we conduct those strikes because they're necessary to mitigate ongoing actual threats, to stop plots, prevent future attacks and save american lives. the strikes are legal, ethical an wise.

>> but as expected, the memo coming under fire from civil rights activists because of how broadly imminent threat is defined. quote, the condition that an operational leader present an imminent threat of violent attack against the united states does not require the united states to have clear evidence that a specific attack on u.s. persons and interests will take place in the immediate future. now, the memo also has new details on legal case behind more drone strikes against al qaeda suspects. such as a strike happened in yemen in september 2011 killing alleged al qaeda operatives, both american citizens not indicted or charged with crimes. all of this could come to a head on thursday for john brennan . eight democratic and three republican senators have written to president obama asking for the legal opinions authorizing the killing of americans . joining me now, national investigative correspondent michael isacoff. i saw your report and the reaction to the report. is it really surprising at this point?

>> well, i think it's not that surprising, mainly because the administration has been so resistant to releasing any of the memos that explain its legal reasoning behind these drone strikes and in particular the drone strikes targeting american citizens. members of congress have asked to see copies. "the new york times" went to court and sued under the freedom of information act to obtain copies. and the administration has completely shut those requests down saying these memos are classified. if they exist and they're not going to discuss or release anything. so that has sort of built pressure up for the administration to show its cards. these are very consequential policies. we are here talking about american citizens who have constitutional rights to life and liberty which can't be deprived without due process of law under the constitution so if they're going to be targeted, with drone strikes, who's making those decisions and what are the criteria that are being used?

>> all right. michael , thank you very much. joining me to talk about the questions posed by michael , jameel jeff ford and director of aclu national security project. thank you for joining us.

>> thank you for the invitation.

>> i would like to play attorney general holder just said today in response to the white paper . let's play it, please.

>> one of the things i want to make sure everybody understands is our primary concern is to keep the american people safe. but to do so in a way that's consistent with our laws and consistent with our values. we are -- we have as a basis for action that we take a congressional statute that allows us to operate against al qaeda and associated entitentities, not only in pakistan or not only in afghanistan but other parts of the world. we say that we only take these kinds of actions when there's an imminent threat , when capture is not feasible and when we are confident that we're doing so in a way that's consistent with federal and international law .

>> does that answer or satisfy your concerns?

>> no. i think that this is a memo that sets out a very broad authority. there are some limit that is are stated in the memo. for example, the administration says that they will carry out these strikes only against people who pose imminent threat but imminence is so broadly defined. and true of the other limitations. the limitations aren't really limitations at all. the other, you know, other issue with the limitations is that the administration says that they're not enforceable by any court so at the end of the day it is executive branch officials making the decision about whether any particular person presents a threat and nobody is looking over their shoulder.

>> i want to read senator diane dpin stei feinstein, her statement this morning says in part as president obama said at time of his death, alaki was the operations leader of aqap. he directed the failed attempt to blow up an airplane on christmas day 2009 and responsible for attempts to blow up cargo planes in 2010 . recruiting others to kill americans until the time of his death in yemen. essentially people read in to that this is a statement that the bad guys were planning something. so this is what needs to happen. you hear a lot of people say, how can you defend these people who were plotting against americans .

>> right. so let's just assume that everything that that statement says about al alawaki is true? this is going to be true of others killed by drone strikes. they have not been under him. one was khan that grew up here in new york. another was a 16-year-old kid. nobody has ever alleged he did anything wrong. you have to make sure that you have checks and balances in place because some of the people that the government target may not be the worse guys in the world and make sure that the next administration has checks on it and the administration after that. even if you trust this administration with the power.

>> especially urgent with the number of drone strikes since 2002 . 4,700 killed in the use of drones. we did the segment with the "time" magazine writer. the cover was a drone nation and talking about the use internationally there.

>> not only actual battlefields but afghanistan. there's no geographic limit set out in the memo that was released yesterday that mike isikoff got hold of. you're not talking about battlefield. you're talking about far removed from actual battlefields and you need to make sure that there are limits in place and for the executive branch to say just trust us is not enough.

>> what do you need to hear from nominee cia nominee john brennan then on the hearing thursday?

>> i think wuone thing the administration should do is release the legal memos before that hearing because this briefing paper is a summary of the legal memos, not the legal memos themselves. that should inform the debate about john brennan 's nomination and then asked about the drone program, about his role in it, what he thinks of the checks and balances in place.

Our Thoughts

I will start at the beginning. ?The system is a breeze to set up. ?My husband has done a lot of putting together in the past few years and he told me this was by far the easiest product that I have reviewed that needed to be assembled. ?Really all he did was attach the wheels. ?As you can see from the picture above, the stroller can fold up into a very small stroller, thus making it easy to fit into small vehicles.

Another feature I love is the adjustable handle. ?It will actually telescope out a little for those of us who may be a little taller than the average Joe. ?If you are a very tall person, you will be thankful for this option!

I love how large the under basket is. ?While it is not enormous (which helps when it folds up) it gets the job done and holds everything that I need it to hold.

The system is very sleek looking. ?I appreciate the clean lines and the bold colors. ?If I had a magic wand, I would have told Eddie Bauer to also offer it in a bold purple or pink for all those little girls out there. ?While red can work for either a boy or girl, this is my last baby and I would love to flaunt her girlie style.

The car seat is extremely lightweight compared to our old system. ?I wish we had this earlier. ?I never realized how heavy these infant seats are until I forgot my stroller and had to lug Caroline in her infant seat through the mall. The infant seat base installs easily and quickly into the car.

Really the only complaint that I have with the system are the straps on the stroller itself. ?The first time I put Caroline in the stroller, I had a hard time getting the straps apart and connected again. ?I can say that this gets easier every time you do it, but the first time was a little difficult and I have a lot of experience with these types of harnesses.

Overall, I love this system. ?We have replaced our old one and will never look back. ?I will be excited once winter is done and we can get out and do a little more hiking. ?I can?t wait to see what this baby can do on the trails!

Kerry makes calls abroad in first weekend on job

WASHINGTON (AP) ? New Secretary of State John Kerry reached out to Israeli and Palestinian leaders in phone calls this weekend, assuring them the Obama administration will continue to pursue a Mideast peace agreement while recognizing the individual concerns on both sides.

Kerry told Israel's Prime Minister Benjamin Netanyahu of his and President Barack Obama's commitment to support Israel's security and to pursue a lasting peace between Israelis and Palestinians. Netanyahu updated Kerry on his work to form a new government. They also discussed Iran and Syria, and pledged to work together closely.

Kerry commended the Israeli decision to release frozen tax revenues to the Palestinian Authority as an important step. Israel's monthly tax transfers to the Palestinians ? the result of taxes and customs duties that Israel collects on behalf of the Palestinians ? are a key element in the Palestinian government budget.

In his conversation Sunday with Palestinian President Mahmoud Abbas, Kerry said Obama "is very interested in the peace process and aware of the economic hardships of the Palestinian people," Abbas spokesman Nabel Abu Rdeneh said. Rdeneh also noted that Kerry said he would visit the region for further talks with Abbas "to preserve the political path." No time was set for the visit.

The State Department said Kerry spoke of his personal commitment to peace between Israelis and the Palestinians. Kerry pledged to continue efforts with the Congress to release budget support funds for the Palestinian Authority and noted the positive step the Israelis had taken by releasing the tax revenues.

The department also said Kerry spoke with Israeli President Shimon Peres on Saturday about the formation of the country's new government, and said the two "exchanged views" on the peace process and regional matters.

On a busy first weekend as America's top diplomat, Kerry also:

?Talked with Japanese Foreign Minister Fumio Kishida and agreed to work closely together to prepare for the visit of Japanese Prime Minister Shinzo Abe to Washington later this month. He thanked Kishida for the role Japan plays in Afghanistan, Burma and in support of the Syrian opposition.

?Talked with South Korean Foreign Minister Kim Sung-hwan and agreed on the need to ensure that North Korea understands that it will face significant consequences from the international community if it continues its provocative behavior.

?Got an update from Turkey's foreign minister, Ahmet Davutoglu, about the investigation into Friday's suicide bombing at the U.S. Embassy in Ankara.

?Spoke with Canadian Foreign Minister John Baird about Iran, Mali and the proposed Keystone XL pipeline that would run from Canada to Texas.

?Spoke with Mexico's foreign minister, Jose Antonio Meade, about the deadly blast at the headquarters of Mexico's state-owned oil company.

?Had lunch with George Shultz, secretary of state under President Ronald Reagan.

Kerry was sworn in Friday afternoon, succeeding Hillary Rodham Clinton in Obama's Cabinet.

Your history may define your future: Tell your doctor

Feb. 4, 2013 ? Your family history is important, not just because it shaped you into who you are today, but it also impacts your risk for developing cancer and other chronic diseases. For example, if one of your family members had cancer, your primary care doctor needs to know. Being able to identify individuals at increased risk can help reduce mortality. In a study published this week in the online version of the Journal of General Internal Medicine, researchers at Brigham and Women's Hospital (BWH) found that patients who use a web-based risk appraisal tool are more likely to have important family history documented.

"Primary care clinicians can play a critical role in documenting a patient's family history and assessing the patient's risk factors for diseases like cancer," explained Heather Baer, ScD, an associate epidemiologist and assistant professor in the Division of General Medicine and Primary Care at BWH. "However, most clinicians see a large number of patients, have limited time during patient visits and may lack adequate systems for collecting and synthesizing this information."

The research team, lead by Baer, set out to evaluate the feasibility and effectiveness of using a web-based risk appraisal tool in a primary care setting. Researchers asked patients who had new patient visits or annual exams, throughout three primary care practices, to fill out the web-based risk appraisal tool on a laptop computer in the waiting room immediately before their visit. Two other primary care practices, where patients did not use the tool, were used for comparison.

A total of 996 patients filled out the tool while waiting for their appointment. The tool asked patients about their family history of cancer as well as lifestyle factors such as diet, physical activity and smoking. At the end of the questionnaire, patients received a report summarizing their risk of cancer, heart disease, diabetes and stroke. Information on family history of cancer was sent to their electronic health record (EHR) for clinicians to view; if accepted by the clinician, it went into coded fields and could trigger reminders for the clinician about colon and breast cancer screening. The researchers measured whether or not new documentation of a positive of family history of cancer was added to the EHR.

"We found that 10.6 percent of patients who used the tool had new information on family history of cancer entered in the EHR within 30 days after their visit, compared to less than one percent of control patients," explained Baer. "This type of risk assessment tool may be useful for collecting information on family history and lifestyle factors and may also help increase communication between physicians and patients about their risk."

One of the limitations of the study was that only a small percentage of eligible patients filled out the tool because of time constraints before their visit. Also, some of the family history information that patients filled in using the tool was not accepted into the EHR by their clinician. Researchers say further research is needed to determine how risk appraisal tools can be integrated with workflow at primary care practices and how they affect screening and health behaviors among patients.
